Client Agreement



This Customer Agreement sets forth the terms and conditions of use of the Piggy Pay™ services (hereinafter referred to as the “Services”) provided by Piggy Pay Inc. (hereinafter referred to as  “Piggy Pay ” , “we” , “us” and “our”).

By opening, registering or using a Piggy Pay Account, or otherwise using the Services, Customers ( hereinafter referred to as “you” and “your” ) agree to be bound by this Customer Agreement and agree to receive communications related to the Services or your Piggy Pay™ Account electronically . Customers are encouraged to carefully read the terms and conditions set forth in this Customer Agreement when registering to use the Services . Piggy Pay™ recommends that you print a copy of this Customer Agreement for your reference . Please note that if you do not accept this Customer Agreement , you will not be able to use the Services . You also agree , by using the Services and accepting this Customer Agreement , to comply with and be bound by the following additional policies :

    •    Privacy Policy , which sets out the terms on which we process any personal data we collect about you , or that you provide to us . By using our Services , you consent to such processing and you confirm that all data provided by you is accurate .
    •    Our Acceptable Use Policy , which sets out the permitted and prohibited uses of our Services .
    •    Our Frequently Asked Questions (FAQ) page provides answers to common customer questions that are included in this User Agreement .
    •    Our AML/KYC Policy sets out important rules and regulations of Piggy Pay™ to combat illegal activities when making payments .
Please read carefully all of the terms of these policies and each other agreement that applies to you . Your use of some Services may be subject to additional terms and conditions that we communicate to you through the Service , and such additional terms and conditions are incorporated into this Customer Agreement . This Customer Agreement is divided into several sections , and you should read them all carefully . Headings are for reference only . Certain capitalized terms have specific definitions that are defined in the Customer Agreement .

    1.    Piggy Pay™ and its branch

Piggy Pay Inc. is a company registered in Canada , British Columbia , with the Financial Transactions Reports Analysis Centre of Canada ( FINTRAC ), registration number C100000051. Registered Address: 1771 ROBSON STREET -1315 VANCOUVER VANCOUVER BC V6G 3B7, CANADA. Piggy Pay Inc. is registered as a money services company and may provide various currency exchange and money transfer services to customers residing in Canada and abroad .

2. Right to participate

To be eligible for our Services , you must be at least 18 years of age or the age of majority in your province or territory of residence . You also represent and warrant to us that if you are an individual and open an account with us on https://piggypay.io ( Piggy Pay Account ), you are acting solely in your own interests and are not acting on behalf of any third party principal or third party beneficiary. You must use the Services only to conduct transactions on your own behalf and not on behalf of any other person or entity.

3. Services Opening an account

In order to use some or all of the Services , you must first open a Piggy Pay Account by providing certain information . For legal reasons, all information you provide during the registration process or at any time thereafter must be complete , accurate and truthful . You are responsible for keeping your mailing address , email address , telephone number and other contact information up to date in your Piggy Pay Account profile. To make changes to your profile , sign in here and then go to your account page . We may refuse or terminate the Services to any person or entity at any time for any reason . We treat all activity on a Piggy Pay Account as registered user activity .

4. Account security and privacy

Protecting your privacy is very important to Piggy Pay. Your passwords are stored on Piggy Pay servers in encrypted form . We do not disclose your personal information , including account details , postal or email addresses , to anyone except when required by law and as stated in our Privacy Policy . Sensitive information between your browser and the https://piggypay.io website ( the “ Piggy Pay Website ” ) is transmitted encrypted using Secure Socket Layer (SSL). When transmitting sensitive information to the Piggy Pay Website , you should always ensure that your browser can verify the https://piggypay.io certificate. You , and not Piggy Pay, are responsible for maintaining adequate security and control of any and all user IDs , passwords or other details you use to access your Piggy Pay account and the Services. You must never disclose your Piggy Pay account password or your customer number ( see our FAQ page for more information on these credentials ). We will never ask you to provide your password to us or a third party . Please let us know if anyone asks for your password and contact Customer Service if you are unsure about this or any other aspect of the security of your Piggy Pay account. You must never allow anyone else to access your Piggy Pay account or observe you accessing your Piggy Pay account.

If you suspect that your Piggy Pay account , login details , password or any other security features have been stolen , lost , used without authorization or otherwise compromised , you are advised to change your password . Contact Customer Service immediately if you believe that your login details have been compromised or you have any concerns about the security of your password or any other security features . Compromise of your login details may allow thieves to access your payment account and attempt to conduct transactions not authorized by you . Calling us by phone can help minimize the risk of loss . Additionally , please contact us immediately if your Piggy Pay account transaction history shows transactions that you did not initiate . You can call our Customer Service hotline at the number listed here or contact Customer Service via our Help Center .

We expect you to regularly review your Piggy Pay account transaction history and to contact Customer Service immediately if you have any questions or concerns . We may ( but are not obligated to ) suspend your Piggy Pay account or otherwise limit its functionality if we have concerns about the security of your Piggy Pay account or any of its security features ; or potential unauthorized or fraudulent use of your Piggy Pay account. For more information , see the section on how Piggy Pay may close your Piggy Pay account below.

You must ensure that your email accounts are secure and accessible only to you , as your email address may be used to reset passwords or to contact you regarding the security of your Piggy Pay account. Notify Customer Service immediately if your email address is compromised . Never use any features that allow login details or passwords to be saved on the computer or browser you are using , or to be cached or otherwise recorded . Additional Piggy Pay products or services that you use may have additional security requirements of which we have notified you , and you should familiarise yourself with these requirements .

5. Duplicate accounts

Piggy Pay reserves the right to refuse the creation of duplicate accounts for the same user due to security and customer identification requirements . In case of detection of duplicate accounts, Piggy Pay reserves the right to close or merge these duplicate accounts without notice to you .

6. Verification

Piggy Pay account and use certain Services , we are required by law to verify some of your information . You authorise Piggy Pay to make any inquiries we deem necessary to verify your identity , directly or through third parties , including checking commercial databases or credit reports . To do this, we may request a credit check together with a verification of ownership of the bank account . If the credit check fails for technical reasons or is unavailable , we will request a certified photo ID . This is sufficient if the ownership of the bank account is also verified .

Piggy Pay reserves the right to access various public and private databases to verify your information . If certain databases provide a match to the information you provide , we may not have to request photographic proof of your identity . Piggy Pay reserves the right to close , suspend or restrict access to your Piggy Pay account and/or the Services in the event that we are unable to obtain or verify this information .

7. Loading money (replenishing the deposit of the Piggy Pay account )

You can load money in supported currencies into your Piggy Pay account to
(i) convert the currency , (ii) send it to another person or to your account, or (iii) hold the balance in your Piggy Pay account for use later . The currencies supported for these actions are listed on our website .

You can load funds using one or more methods , such as pre-authorised direct debit via Electronic Funds Transfer ( 'EFT ' ) or bank transfer from your bank account, using a credit or debit card or Interac ™. The number of methods available to you will depend on a number of factors , including your verification status with us . Loading methods are not part of our Services , but are services provided by third parties . We cannot guarantee the use of any particular loading method and may change or stop offering a particular loading method at any time without notice .

We will credit your Piggy Pay account as soon as we receive your money and are not responsible for the money you have loaded until we receive it . For some specific loading methods, we will credit your Piggy Pay account as soon as possible, subject to our right of cancellation . This means that if the actual amount you intended to load does not reach us within a reasonable time, we may deduct such amount from your Piggy Pay account. For more information , see Cancellations and chargebacks . If there are not enough funds in your Piggy Pay account for this purpose , we may seek a refund from you using other methods . Load money using pre-authorised direct debit

If you choose to load money using our Pre-Authorised Direct Debit feature to directly debit your bank account , you will be required to provide , or we will obtain through the bank login information provided by you, your bank account details , including your bank account number and routing number . When you choose to load money using our Pre-Authorised Direct Debit feature and provide your bank account details , you confirm that your bank account details are correct , that you are authorised to access and transfer funds from your bank account , that there are sufficient funds in your account to enable the loading , that your bank account is in good standing with the financial institution where the account is held and that you have the authority to initiate an electronic funds transfer in the amount in question to or from your bank account . Your authorization will remain in effect for each transaction unless it is revoked in accordance with this Customer Agreement , in which case we will promptly return the deposit to the account from which it was sent , assuming the funds have not yet been received by Piggy Pay. In the event that we are unable to return the deposit , we will promptly contact you using the most current contact information you provided when registering your Piggy Pay account .

Load money using a debit or credit card

If you choose to load funds using a debit or credit card , you will need to provide your card details , including the card number and cardholder name . When you choose to load funds using a debit or credit card , you represent that your card details are correct , that you are authorized to access and transfer funds from your card account , that your card account is in good standing with the financial institution where the account is held , and that you have the authority to initiate a debit or credit card payment in the amount you are referring to , to or from your card account .

Upload funds via Interac ™

If you choose to load funds via Interac ™, you will need to provide your email address or phone number . When you choose to load funds via Interac ™, you confirm : that you are authorized to access and transfer funds from your bank account via Interac ™, and that you have the authority to initiate an Interac ™ electronic transfer or approve an Interac ™ payment request in the amount you are referring to or from your bank account . The bank you choose to complete an Interac ™ electronic transfer may have limits on the amount you can send in each Interac ™ electronic transfer and on the frequency of Interac ™ electronic transfers you can have in a given period of time .

Upload funds via bank transfer
or by electronic transfer of funds from your bank account

If you choose to load funds via Electronic Funds Transfer from your bank account or Internal Bank Transfer , your transaction order will remain inactive until we receive your funds in our nominated account . Such payments must be made to our nominated account via Electronic Funds Transfer or Internal Bank Transfer . In cases where a loading transaction is cancelled or declined for any reason, we will promptly refund the deposit to your bank account from which the transaction was made . In the event that we are unable to refund the deposit , we will promptly contact you using the most current contact information you provided when registering with Piggy Pay.

No other methods of payment are accepted, including cash, cryptocurrencies or any virtual assets, postal checks or electronic checks . Financial restrictions may apply to certain payment methods or currencies . For more information, please visit our Frequently Asked Questions section . If you have chosen a loading method that entitles you to a chargeback and refund (for example, with your credit card , you can ask your card provider to reverse the transaction on your card ), please see the Cancellations and Chargebacks section below.

For legal and security reasons, we may impose limits on the amount of funds you can load into your Piggy Pay account.

8. Receiving money from third parties
and payment through our banking partners

In some currencies, we may provide you with certain bank details that you may in turn provide to third parties to enable them to send money to your Piggy Pay account using either an electronic funds transfer method or a domestic bank transfer method. These account details are offered by our third party banking partners . These certain bank details that we provide to you to receive funds from third parties are for accounts held by Piggy Pay and its affiliates ( and we will credit your Piggy Pay account held by us upon receipt of such funds ), and not for a bank account held by you.

When someone sends money to your Piggy Pay account using a method we support , the money will appear in your Piggy Pay account and will be reflected in the relevant currency in your Piggy Pay account. You should regularly check the incoming funds in your Piggy Pay account against your own records and notify us if there are any irregularities . When you receive funds , you can either accept them as is and keep the balance in your Piggy Pay account in that currency, or accept them and then convert them to another currency and hold that currency or send them to your account or a third party account . For details , see the Currency Conversion section below . If you choose to receive funds using this method , you will not have access to such funds until we have received the funds in our nominated account . You will be notified to your registered email when funds are received .

You acknowledge that money received into your Piggy Pay account via this method may be reversed or refunded and you agree that we may deduct the amount received from your Piggy Pay account if it is reversed by the person who paid you the amount received or by any relevant payment service provider . In cases where a transaction is reversed or declined for any reason, we will promptly refund the deposit to the bank account from which the transaction was made . In the event that we are unable to refund the deposit , we will contact you promptly using the most current contact information provided to us when registering your Piggy Pay account.

If you provide the account details we provide to you to a third party , you agree that you will not be charged an additional fee or any other charge solely for accepting payments through the Service offered by Piggy Pay. You are not permitted to receive payments by other payment methods, including cash , postal check or electronic check . Financial restrictions may apply to certain payment methods or currencies , please visit our Frequently Asked Questions section for more information .

9. Maintaining the balance in your Piggy Pay account

Piggy Pay is not a bank , and your Piggy Pay account is not a bank account .
Piggy Pay is not a bank and therefore the value held as a balance in your Piggy Pay account represents an unsecured claim against Piggy Pay and is not insured by the Canada Deposit Insurance Corporation (CDIC) or any other deposit protection scheme . Piggy Pay owns the interest or other earnings from these investments , if any . Piggy Pay does not use balances held by its customers for operating expenses or other corporate purposes . Additionally , as discussed above , the specified bank account details we provide to you to enable you to receive funds from third parties are for accounts held by Piggy Pay and its affiliates ( and we will credit your Piggy Pay account held by us upon receipt of such funds ), and not for a bank account held by you.

Transaction history

All your transactions ( including your balance , loaded money and money you have received , converted, sent and /or withdrawn), including related fees and exchange rates , if applicable, are recorded in the transaction history section of your Piggy Pay account.
You can access this information by logging into your Piggy Pay account. We have allocated a transaction number for each transaction. and you should quote this transaction number when communicating with us about a specific transaction .


10. Managing money in multiple currencies

Piggy Pay account balance may be held in certain currencies supported by Piggy Pay from time to time. You may hold a balance in more than one of these currencies at a time . You are responsible for all risks associated with maintaining a Piggy Pay account balance in multiple currencies. You may not manage multiple currencies for speculative trading purposes .


11. Withdrawing or sending money

If you have a balance in your Piggy Pay account, you can delete it as follows :

Withdraw money by sending it to your bank account (regardless of whether your bank account is in Canada ) via electronic funds transfer or other method , depending on the currency ;
Send to a third party bank account (regardless of whether it is in Canada ) via electronic funds transfer or other method , depending on the currency .
The number of payment methods available to you will depend on a number of factors , including your verification status with us . We cannot guarantee the use of any particular payment method and may change or stop offering a payment method at any time without notice , but we guarantee that at least one payment method will be available to you unless prohibited by applicable law .

We charge you a fee for each withdrawal or request for money . We will notify you of the exact amount when you submit your request . You can also find out more information about the fees we charge on the pricing page and below in the Fees section . Payout methods are not part of our Services , they are services provided by third parties , such as a bank where you or third party recipients have a bank account .

Limits on withdrawal and sending money
You agree that your Piggy Pay account is subject to withdrawal and sending of funds . If your withdrawal request exceeds the current limit , we may reject your request or impose additional checks or impose additional obligations or time limits before allowing the withdrawal .

Delay in withdrawing or sending money
We have no control over the time it may take for your or the recipient's bank or payment service provider to credit and make funds available to you or your recipient after we make the funds available to you , the recipient's bank or payment service provider .

In certain situations, we may delay a withdrawal , including if we need to confirm that the withdrawal was authorised by you , or if other payments to your Piggy Pay account have been reversed , for example as a result of a chargeback or bank transfer reversal ( see Payment Reversals and Refunds for more information ).

12. Currency conversion

Our services include the ability to convert currencies , such as:

    •    You can load money in one currency and use that balance to send money to a third party in another currency ;
    •    You can load money in one currency and use that balance to withdraw money in another currency ; or
    •    You can convert the currency balance in your Piggy Pay account into another currency to hold in your Piggy Pay account.
When converting currencies, a conversion fee will be charged . You can also find out more information about the fees we charge on the pricing page and below in the Fees section .
You need to set up a currency conversion order from your Piggy Pay account, and in each case the currency conversion order will be a "Fixed Source Order" , which is a currency conversion order where you specify that you want to convert a fixed amount of the source currency ( the currency you start with ) so that you or your recipient receives the converted amount in the target currency ( the currency you want to send or eventually receive in your account ).

We will only process your currency conversion order if we have or have received the appropriate funds and fees as detailed on the pricing page and in the fees section below from your Piggy Pay account. You are responsible for sending us the money to fund your currency conversion order in a timely manner . We cannot be held responsible for the time it takes for your bank or payment service provider to send us the money .

Refusal of a Currency Conversion Order . We reserve the right, in our sole discretion, to refuse any currency conversion order . Reasons for refusal may include , but are not limited to , incorrect recipient information , insufficient funds available, or where we believe that you may have breached this Customer Agreement , including where we believe that you are attempting to engage in currency trading or other trading for purposes not permitted by this Customer Agreement . We will endeavour to notify you of any refusal using the contact details in your Piggy Pay account , setting out ( where possible ) the reasons for such refusal and explaining how to correct any errors . However, we will not notify you where such notification would be unlawful .

Once we receive your currency conversion order, we will send you a confirmation email that it has been received . Each currency conversion order is assigned a unique transaction number that will appear in the transaction history in your Piggy Pay account . You should quote this transaction number when communicating with us about a specific currency conversion order .

When will I be notified about my next scheduled transfers ? If you scheduled a transfer in advance , we will notify you 24 hours before the upcoming transfer, indicating the total cost and the estimated “live” exchange rate for that transfer . By scheduling a transfer , you agree that Piggy Pay will send the funds at the current exchange rate at any time on the scheduled date . If you have signed up to receive emails , we will send you a transfer receipt once the scheduled transfer has been successfully sent . 13. Exchange rate used to convert currency

We will inform you of the exchange rate :

    •    when you place a currency conversion order , if it is a currency conversion order with a guaranteed rate ; or
    •    when we receive your payment if this is an order for currency conversion at a non-guaranteed rate .

14. Guaranteed rates

We will notify you of the guaranteed rate and guaranteed period of time ( the "Guaranteed Period" ) when you create your money transfer .

Guaranteed periods are subject to the following conditions :

(a) The guaranteed period may be extended if your money transfer is created on a weekend or holiday .
(b) We must receive sufficient funds from you within the Guaranteed Period to convert your money at the Guaranteed Rate . You will see when we receive your money by logging into your Piggy Pay Account.
(c) If we receive your funds after the Guaranteed Period , we will not be able to convert your money at the guaranteed rate and your transfer will become a non-guaranteed rate transfer . Accordingly , we may convert your money at the applicable exchange rate at the time we receive your money or we will email you and ask if you wish to continue your transfer at the new exchange rate .
(d) If the relevant exchange rate ( as provided by our exchange rate reference provider ) changes by 5% or more during the Guaranteed Period , we may, at our discretion, suspend your transfer for a reasonable period of time or cancel your transfer and refund you .
(e) For some currencies , including those where you send money from Japanese Yen (JPY), the guaranteed rate will only be offered after your address has been verified by us .
(f) We may change the terms of the Guaranteed Rate or suspend the Guaranteed Rate feature at any time .

Conversion restrictions

We may impose limits on the amount of currency that you may convert at any one time , for further information on applicable limits please visit our Frequently Asked Questions page . We may limit the amount of your currency conversion order in accordance with our obligations under applicable law and at our discretion . If your currency conversion order is received by us after 5:00 PM on a Business Day or on a non -Business Day , your currency conversion order will be deemed to have been received on the following Business Day .

Delay in conversion

We carry out checks and these checks may increase the time it takes to process your currency conversion order . We cannot be held responsible for any delays caused by these checks . The completion time of your currency conversion order (i.e. the date the funds will be available to the recipient ) will be communicated to you in your confirmation when you complete the setup of your transaction order .

Canceling your currency conversion order

You may cancel your currency conversion order for a full refund at any time before the transaction amount has been converted in accordance with your instructions . However, frequent cancellations may result in us restricting your use of the Services .

You are responsible for ensuring that the instructions you provide to us are accurate . Once Piggy Pay has executed your payment instructions , transactions cannot be reversed and we will not be liable for any losses you incur as a result of a transaction executed in accordance with your instructions .

Automatic conversion .

For some currencies, you may be able to set up one or more conversion orders that will be automatically executed once the exchange rate you select is offered by our Services ( an "automatic conversion order" ). There may be limits on the number of automatic conversion orders you may set up , as well as on the amounts of money you may schedule to be converted . Piggy Pay does not guarantee that it will be able to execute your automatic conversion order in all circumstances .

We are not a currency trading platform .

Piggy Pay is not a currency trading platform and accordingly you should not use our Services , including your Piggy Pay Account or the Auto Conversion Order feature for this purpose ( including creating multiple Auto Conversion Orders or a series of money transfers without the intention of completing them or to profit from forex trading ). If we discover that you are using our Services for this purpose , we may, at our sole discretion, impose a limit on the number of Auto Conversion Orders you can create , cancel your orders , impose a limit on the amount of money you can convert or transfer in one or more currencies or in the same currency , restrict your ability to use this or other features, or suspend or close your Piggy Pay Account and seize your proceeds .

15. Fees and taxes

Fees for withdrawing and sending money , as well as currency conversion, will be disclosed to you when you place your order and before the transaction is confirmed . You can also view the fee structure on our Pricing Page . For clarity, the fees applicable to you on the Pricing Page are part of this Customer Agreement and are subject to change .

You agree to pay the applicable fees using your chosen payment method when making a deposit to PiggyPay.io . The fee will be charged at the time of withdrawal or currency conversion . Our fees do not include any fees that your bank or the recipient's bank may charge . These fees may be deducted from the money you load into your Piggy Pay account or the balance in your Piggy Pay account . We will not process your currency conversion order until we receive the applicable fee from you .

You are responsible for paying any taxes that may apply to payments you make or receive , and it is your responsibility to collect , report and pay the correct tax to the appropriate tax authority .

We may charge you a separate variable fee during periods of potentially increased volatility or unpredictability in the FX market as determined by Piggy Pay. We will let you know if this fee applies when you set up your order , for more information see here.

16. Piggy Pay account

You can close your Piggy Pay account
Piggy Pay account at any time by contacting our Customer Support Hotline at +17783731171 or by email through our Help Center .

If you still have assets in your Piggy Pay account at the time of closure, you must withdraw them within a reasonable period of time by following the steps outlined above in the Withdrawing or Sending Money section . You should not close your Piggy Pay account to avoid an investigation . If you attempt to close your Piggy Pay account during an investigation, we may hold your money until the investigation is fully completed. You agree that you will remain responsible for all obligations associated with your Piggy Pay account even after it is closed .

17. Piggy Pay may close your Piggy Pay Account

Piggy Pay reserves the right, in its sole discretion, to suspend or terminate this Customer Agreement , as well as access to our Websites , software , systems ( including any networks and servers used to provide any Services ) operated by us or on our behalf , or to some or all of the Services for any reason and at any time upon notice to you , and upon termination of this Customer Agreement, to pay you any unrestricted funds held in your Piggy Pay balance.

Reasons why we may close your Piggy Pay account include , but are not limited to :

    •    your violation of any provision of this User Agreement or the documents referred to in this User Agreement ;
    •    we are requested or directed to do so by any competent court , government authority or agency , or law enforcement agency ;
    •    we have reason to believe that you are in violation of any applicable law or regulation ;
    •    we have reason to believe that you are involved in fraudulent activity , money laundering , terrorist financing or other criminal or illegal activity .
We may also suspend your Piggy Pay account if it has been compromised or for other security reasons, or has been or is being used without your permission or fraudulently . For details , see the Account Security and Privacy section above .

Piggy Pay account or terminate your use of the Services for any reason, we will notify you of our action and make all unrestricted prepaid funds held in your Piggy Pay account available for withdrawal .

In the event of any loss , claim, cost or expense ( including reasonable legal fees ) arising from your breach of this Agreement , any applicable law or regulation and/ or your or any authorized third party's use of our Services , you agree to defend , indemnify and hold us and our affiliates harmless . This provision will survive the termination of our relationship .

18. What happens if you owe us money ?

In the event that you become liable for any amounts owed to us , we may immediately remove such amounts from your Piggy Pay account ( if any ). If there are insufficient funds in your Piggy Pay account to cover your liability , we reserve the right to collect your debt to us using any payments received into your Piggy Pay account , failing which you agree to reimburse us by other means . We may also collect amounts you owe us by other collection methods , including , without limitation , using a debt collection agency . We may recover all reasonable costs or expenses ( including reasonable attorneys' fees and costs ) incurred in connection with the enforcement of this Customer Agreement .

19. Communications

We are required to provide you with certain information in writing . By accepting this Customer Agreement , you agree that we may communicate with you electronically, either by email or by posting notices on the Site.

We may call or text you at the phone number(s) you have provided to us . We may call or text you to (i) notify you about your Piggy Pay account or account activity , (ii) investigate or prevent fraud, or (iii) collect a debt owed to us . We may share your phone number(s) with service providers we contract with to help us provide services to you , but will not share your phone number(s) with third parties for their own purposes without your consent . Standard rates for phone minutes and text messages may apply . We will not call you or text you for marketing purposes .

20.  Problems that may arise
Cancellations and refunds

You are responsible for all reversals , chargebacks , claims , fees , fines , penalties and other liabilities incurred by Piggy Pay caused by or arising out of your breach of this Customer Agreement and / or your use of the Services . You agree to indemnify Piggy Pay for any and all such liabilities . Whenever a transaction is reversed , Piggy Pay will refund or reverse the transaction from your Piggy Pay account in the same currency as the original transaction . If the balance of your Piggy Pay account in a particular currency is insufficient to cover the refund or reversal amount , Piggy Pay will perform a currency conversion to refund or reverse the transaction , depending on the exchange rate offered by Piggy Pay in the applicable currencies at that time .

Payments to you may be invalidated and cancelled by Piggy Pay if:

    •    Our investigation into the bank transfer reversal revealed that the transaction was fraudulent .
    •    Piggy Pay sent you a payment in error .
    •    The payment was unauthorized or invalidated by the sending bank.
    •    You have received payment for actions that violate this Customer Agreement , the Acceptable Use Policy or any other agreement between you and Piggy Pay.
    •    Piggy Pay has a claim against you for these funds .
When you receive a payment, you are liable to Piggy Pay for the full amount of the payment sent to you , as well as for any fees if the payment is subsequently found to be invalid for any reason.

21. Negative account balances

If your Piggy Pay account balance goes into negative for any reason, including due to a payment being cancelled or returned , that negative balance represents the amount you owe Piggy Pay and you agree to pay off the negative balance immediately without notice from us . Piggy Pay may deduct amounts owed from the money you load or the money you receive into your Piggy Pay account. If you manage your balance in your Piggy Pay account in multiple currencies and the balance in one currency goes into negative for any reason, Piggy Pay may pay off the negative balance using the value you maintain in the other currency . Piggy Pay will perform a currency conversion to do this , which will depend on the exchange rate offered by Piggy Pay in the applicable currencies at that time . We may send you reminders or take other reasonable steps to collect a negative balance from you , such as using a debt collection service or taking further legal action . To collect a negative account balance from you , we may convert the amount you owe us into Canadian dollars .

22. Errors and unauthorized transactions

To protect yourself from errors and unauthorized activity , you should regularly log into your Piggy Pay account and review your Piggy Pay account statement . Piggy Pay will notify you of each transaction by sending an email to your primary email address on file . You should review these transaction notifications to ensure that each transaction has been authorized and completed correctly .

Piggy Pay will protect you from unauthorized activity and errors in your Piggy Pay account . When this protection applies , Piggy Pay will cover you for the full amount of unauthorized activity as long as you cooperate with us and follow the procedures outlined in this section . If this section requires you to notify us , please do so by calling the Customer Service Hotline on +17783731171 or by contacting Customer Service by email through our Support Center .
We will correct any errors we find .

If the error results in :
If you receive less than you are owed , we will credit your Piggy Pay account with the difference between what you should have received and what you actually received .
If you receive more than you were entitled to , we will debit your Piggy Pay account for the difference between what you actually received and what you should have received .

23. Currency conversion errors

In relation to currency conversion orders, the following are considered errors :

    •    You paid the wrong amount for a currency conversion order ;
    •    The site made a computational error , such as incorrectly calculating the amount received by the recipient;
    •    The amount shown on the currency conversion receipt provided to the sender has not been provided to the recipient unless the problem was caused by extraordinary circumstances beyond our control ; and
    •    The funds were made available to the recipient later than the availability date shown to you on the currency conversion receipt or were not delivered , unless the delay was due to extraordinary circumstances beyond our control (such as the actions of third parties ) and we could not reasonably have foreseen those circumstances , or the delay was due to fraud checks, FINTRAC requirements or similar requirements , or the transfer was made with fraudulent intent .
If you believe that an Error of the type described above has occurred and you have properly contacted us in accordance with the information above , we will investigate and determine whether an Error has occurred within 90 days ( although we typically do so within ten ( 10 ) business days) of you contacting us . We will notify you of our decision within three (3) business days of completing our investigation .

24. Account balance errors and unauthorized transactions

Piggy Pay account balance , the following events are considered errors :

    •    When money has been mistakenly withdrawn from your Piggy Pay account or mistakenly credited to your Piggy Pay account, or when a transaction has been mistakenly recorded in your Piggy Pay account;
    •    You send money to a third party or withdraw money and the wrong amount is debited from your Piggy Pay account ;
    •    An incorrect amount has been credited to your Piggy Pay account ;
    •    A transfer to or from your Piggy Pay account is missing or incorrectly listed on your Piggy Pay account statement;
If you believe that an error of the type described in this section has occurred and you properly contact us in accordance with the information above , we will investigate and determine whether an error has occurred within ten (10) business days of hearing from you and will correct any error promptly . However , if we need more time , we may take up to forty-five (45) days to investigate your complaint or question , and in certain circumstances we may credit your Piggy Pay account for the amount you believe is in error until we complete our investigation . For new Piggy Pay accounts , it may take us up to twenty (20) business days to credit your Piggy Pay account for the amount you believe is in error . We will notify you of the results within three (3) business days of completing our investigation . If we determine that no error has occurred , we will send you a written explanation . You can request copies of the documents we used in our investigation .

25. What is an unauthorized transaction ?

An unauthorized transaction occurs when money is sent from a balance in your Piggy Pay account that you have not authorized with your two-factor verification and that has not provided you with any benefit . For example, if someone steals your password, uses the password to access your Piggy Pay account, and sends a payment from your Piggy Pay account , an unauthorized transaction has occurred.

The following actions are not considered unauthorized transactions :

If you give someone access to your Piggy Pay account ( by giving them your login details ) and they use your Piggy Pay account without your knowledge or permission. You are responsible for the transactions made in this situation .
Payment cancellations and reversals as a result of actions described in the section "Payment Cancellations and Refunds" .
If you believe your Piggy Pay login information has been lost or stolen , please call +17783731171 or email [email protected] or write to: 1771 ROBSON STREET -1315 VANCOUVER VANCOUVER BC V6G 3B7, CANADA Piggy Pay Compliance.

Notify us immediately if you believe your Piggy Pay login details have been lost or stolen , or if you believe transactions have been made on your Piggy Pay account without your permission using your login details . You could lose all the money in your Piggy Pay account. If you notify us within 60 days after we provide you with a statement for your Piggy Pay account showing transactions you did not make , you will be entitled to 100% protection against unauthorised transactions .

Additionally , if your Piggy Pay account statement shows transfers you did not make , including those made using your Piggy Pay credentials or other means, please let us know immediately . If you do not tell us within 60 days of us providing you with the statement , you may not get back the money you lost after 60 days unless we can prove that we could have stopped someone else from taking the money if you had told us in time . If a valid reason (such as a long trip or hospital stay ) prevented you from telling us , we will extend the deadline .

You may link to our website , provided that you comply with the terms and conditions of this Customer Agreement and follow certain rules . You may link to our website , provided that :

    •    You do this in a way that is fair and legal and does not damage our reputation or take advantage of it ;
    •    you do not imply any form of association , approval or endorsement on our part where none exists ;
    •    You do not frame our Site on any other site;
    •    you do not refer to any of our Services as “banking” services ; and
    •    A site that links to our Site complies with our Acceptable Use Policy .
We reserve the right to revoke such permission to withdraw the link without prior notice and for any reason .

Wise Application ( Effective from the moment applications are accessed )
As your agreement to comply with the terms of this User Agreement, we grant you a non-transferable , non-exclusive license to use the App on your device in accordance with this User Agreement and the Appstore Rules. We reserve all other rights . Updates to the App may be released from time to time through the App Store or Google Play. Depending on the update, you will not be able to use our Services through the App until you download the latest version of the App and accept any new terms .

In addition to your agreement to the foregoing terms and conditions , and notwithstanding anything to the contrary in this Agreement , the following provisions apply with respect to your use of any version of the App that is compatible with the iOS operating system of Apple Inc. ( “ Apple ” ). Apple is not a party to this Customer Agreement and does not own or assume responsibility for the App . Apple provides no warranty for the App , except, if applicable, a refund of the purchase price for the App . Apple is not responsible for providing maintenance or other support services in connection with the App and will not be liable for any other claims , losses , liabilities , damages , costs or expenses with respect to the App , including any third-party product liability claims , claims that the App fails to conform to any applicable legal or regulatory requirement , claims arising under consumer protection or similar legislation , and claims of intellectual property infringement . Any inquiries or complaints regarding the use of the Application , including those regarding intellectual property rights , should be directed to Piggy Pay in accordance with this Customer Agreement . The license granted to you by this Agreement is limited to a non-transferable license to use the Application on an Apple -branded product running Apple's iOS operating system and owned or controlled by you , or as otherwise permitted by the Usage Rules set forth in Apple 's App Store Terms of Service . In addition , you must comply with the terms of any third-party agreement that applies to you when using the Application , such as your wireless data service agreement . Apple and Apple 's subsidiaries are third-party beneficiaries of this Customer Agreement and, upon your acceptance of the terms and conditions of this Customer Agreement, will have the right ( and will be deemed to have accepted the right ) to enforce this Customer Agreement against you as a third-party beneficiary ; Notwithstanding the foregoing , our right to enter into , terminate or discontinue any amendment , waiver or settlement under this Agreement with Customer shall not require the consent of any third party .

27. Information security

Please see the Account Security and Privacy section above for more information on how to keep your Piggy Pay account secure . You are responsible for configuring your information technology , computer programmes and platform to access our Services . You should use your own anti-virus software . You must not misuse our Services by introducing viruses , trojans , worms, logic bombs or other material which is malicious or technologically harmful . You must not attempt to gain unauthorised access to the Services or our Website , our servers , computers or databases . You must not attack the Services , including via our Website, via any denial-of-service attack . By breaching this provision , you would commit a criminal offence under applicable law . We may report any such breach to the relevant law enforcement authorities and we may co-operate with those authorities by disclosing your identity or other information to them . In the event of such a breach, your right to access and use our Website and/or our Services will cease immediately without notice and you must immediately cease all such access and use .

28. Third party services

You acknowledge and agree that the Company may engage third party partners and suppliers to provide the Services to you . Certain features of the Website or Application may provide access to information , products , services and other materials provided by third parties ( “Third Party Materials” ) or allow the routing or transmission of such Third Party Materials , including via links . By using such features , you direct us to access , route and transmit to you the relevant Third Party Materials .

We do not control , endorse, or accept responsibility for any Third Party Materials , including the accuracy , validity , timeliness , completeness, reliability , integrity , quality, legality , usefulness, or safety of Third Party Materials or any intellectual property rights therein . Some Third Party Materials may , among other things , be inaccurate , misleading, or deceptive . Nothing in this Agreement shall be deemed to be a representation or warranty by us with respect to any Third Party Materials . We have no obligation to monitor Third Party Materials , and we may block or disable access to any Third Party Materials ( in whole or in part ) through the Website or App at any time . In addition , the availability of any Third Party Materials through the Website or App does not imply our endorsement of or affiliation with any provider of such Third Party Materials , and such availability does not create any legal relationship between you and any such provider .

Your use of Third Party Materials is at your own risk and is subject to any additional terms , conditions, and policies that apply to such Third Party Materials ( such as the terms of service or privacy policies of the providers of such Third Party Materials ).

29. Limitations of Liability and Other General Conditions

SOME PROVINCES AND TERRITORIES DO NOT ALLOW THE EXCLUSION OF LIMITATION OF LIABILITY FOR ALL TYPES OF DAMAGES (INCLUDING THE PROVINCE OF QUEBEC). IN SUCH PROVINCES , PIGGY PAY WILL BE LIABLE TO YOU ONLY FOR THOSE DAMAGES FOR WHICH WE ARE EXPRESSLY LIABLE TO YOU UNDER APPLICABLE LAW.

IN ANY OTHER CASE, YOU EXPRESSLY UNDERSTAND AND AGREE THAT UNDER NO CIRCUMSTANCES WILL WE (INCLUDING, MOST LIMITED TO, OUR PARENT COMPANY AND AFFILIATES), OR PIGGY PAY’S OFFICERS, DIRECTORS, AGENTS, JOINT VENTURERS, EMPLOYEES, OR SUPPLIERS (INCLUDING, MOST LIMITED TO, OUR PARENT COMPANY AND AFFILIATES) BE LIABLE FOR ANY LOST PROFITS OR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. PUNITIVE DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF DATA OR LOSS OF BUSINESS) ARISING OUT OF OR IN CONNECTION WITH OUR SITE, SERVICES OR THIS CUSTOMER AGREEMENT (HOWEVER ARISING, INCLUDING NEGLIGENCE). IN ADDITION, TO THE EXTENT PERMITTED BY APPLICABLE LAW , PIGGY PAY ( INCLUDING, FOR GREAT CERTAINTY, OUR PARENT COMPANY AND AFFILIATES) AND OUR (AND THEIR RESPECTIVE) OFFICERS, DIRECTORS, AGENTS, JOINT VENTURERS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE, AND YOU AGREE NOT TO HOLD ANY OF THESE PARTIES LIABLE, FOR ANY DAMAGES OR LOSSES (INCLUDING, BUT NOT LIMITED TO, LOSS OF MONEY, GOODWILL OR PROFITS OR OTHERWISE) INTANGIBLE LOSSES OR ANY SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, WHETHER ARISING DIRECTLY OR INDIRECTLY FROM: (A) YOUR USE OF OR INABILITY TO USE THE Piggy Pay SITES AND SERVICES; (B) DELAYS OR DISRUPTIONS IN THE OPERATION OF THE Piggy Pay SITES AND SERVICES; (C) VIRUSES OR OTHER HARMFUL SOFTWARE OBTAINED THROUGH ACCESSING THE Piggy Pay SITES OR SERVICES OR ANY SITE OR SERVICE LINKED TO THE Piggy Pay SITES OR SERVICES; (D) ANY INTERRUPTIONS, ERRORS, OR INACCURACIES OF ANY KIND IN THE Piggy Pay SITES OR SERVICES OR IN THE INFORMATION AND GRAPHICS OBTAINED THEREFROM; (E) THE CONTENT, ACTIONS, OR OMISSIONS OF ANY THIRD PARTIES; (F) SUSPENSION OR OTHER ACTION TAKEN WITH RESPECT TO YOUR ACCOUNT; (G) YOUR NEED TO CHANGE PRACTICES, CONTENT, OR CONDUCT OR YOUR LOSS OF OR INABILITY TO DO BUSINESS AS A RESULT OF CHANGES TO THIS AGREEMENT OR Piggy Pay POLICIES. Piggy Pay RESERVES THE RIGHT TO CHANGE ITS POLICIES AND THIS CLIENT AGREEMENT AT ANY TIME IN ACCORDANCE WITH THE PROVISIONS SET FORTH HEREIN.

Service availability

We will try to make our Services available to you when you need them . However , we do not guarantee that our Services will always be available or will be uninterrupted . We have the right to suspend , withdraw , discontinue or change all or any part of our Services without notice . We will not be liable to you if for any reason our Services are unavailable ( in whole or in part ) at any time or for any period . You are responsible for making all arrangements necessary for you to have access to the Services ( including all hardware and telecommunications services ).

No guarantee

SOME PROVINCES AND TERRITORIES DO NOT ALLOW THE EXCLUSION OF WARRANTIES (INCLUDING THE PROVINCE OF QUEBEC). IN THESE PROVINCES AND TERRITORIES, THE ONLY WARRANTIES YOU HAVE ARE THOSE THAT ARE EXPRESSLY REQUIRED BY APPLICABLE LAW.

IN ALL OTHER PROVINCES AND TERRITORIES, EXCEPT AS EXPRESSLY PROVIDED HEREIN , PIGGY PAY, OUR EMPLOYEES AND OUR SUPPLIERS PROVIDE THE SERVICES "AS IS" AND WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS , IMPLIED OR STATUTORY . PIGGY PAY, OUR EMPLOYEES, AND OUR SUPPLIERS EXPRESSLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

30. Events beyond our control

«https://piggypay.io», «Piggy Pay», «Piggy Pay Wallet» — all logos associated with the Services that are either trademarks or registered trademarks of Piggy Pay or Piggy Pay's licensors. You may not copy , imitate , modify or use them without Piggy Pay's prior written consent . In addition , all page headers , custom graphics , button icons and scripts are service marks , trademarks and / or trade dress of Piggy Pay. You may not copy , imitate , modify or use them without our prior written consent . You may use the HTML logos provided by Piggy Pay with for the purpose of directing web traffic to the Services. You may not alter , modify, or change these HTML logos in any way, use them in a manner that mischaracterizes Piggy Pay or the Services, or display them in any manner that implies sponsorship or endorsement by Piggy Pay. All rights , title and interest in and to the Piggy Pay website, any content thereof, the Services, the technology associated with the Services , and any technology and any content created or derived from the foregoing are the exclusive property of Piggy Pay and its licensors .

31. Piggy Pay — payment service provider

Our relationship with you under this Customer Agreement is that of a payment service provider and Piggy Pay is an independent contractor for all purposes . Piggy Pay is not your agent or fiduciary .

32. Full Agreement

This Customer Agreement , together with any applicable policies and agreements incorporated herein and on the Piggy Pay Website, sets forth the entire understanding between you and Piggy Pay with respect to the Services . Certain terms , which by their nature should survive termination , will survive the termination of this Agreement . If any provision of this Agreement is held invalid or unenforceable , such provision will be severed and the remaining provisions will be enforced .

33. Law and Jurisdiction

The provision of the Services and any dispute or claim arising out of the provision of the Services shall be governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein . Any dispute or claim arising out of or in connection with the Service , this Customer Agreement or the use of the Website shall be subject to the non-exclusive jurisdiction of the courts of the Province of British Columbia .

Language
The parties have agreed that this Client Agreement and all related documents will be drawn up in English .

34. Other information about this customer agreement

You may not transfer or assign any rights or obligations you have under this Customer Agreement without Piggy Pay's prior written consent . Piggy Pay may transfer or assign this Customer Agreement or any right or obligation under this Customer Agreement at any time .
Each of the clauses of this Client Agreement operates separately . If any court or relevant authority decides that any of them is unlawful , the other clauses will remain in full force and effect . If we delay in asking you to do certain things or taking action , this will not prevent us from taking steps against you at a later date .
Our failure to act with respect to a breach by you or others of any of your obligations under this Customer Agreement does not waive our right to act with respect to subsequent or similar breaches .
This Customer Agreement , including any terms and conditions incorporated herein , constitutes the entire agreement between you and us with respect to the subject matter hereof and supersedes any and all prior or contemporaneous written or oral agreements or understandings . This Agreement is between you and us . No other person has any right to enforce any of its provisions . This Agreement does not create, and shall not be construed to create, any partnership, joint venture , employer-employee relationship , agency, or franchisor - franchisee relationship between you and us .
